NOT HAPPENING, BUT... The Concept of Raising Rents On Everyone Because of "Financial Hardship"???


Okay, calm down.  It's not happening.  In another instance of a post on the TA Facebook opening up a new concern for tenants, we find out from someone who has been having discussions with the leasing office, this:

"The woman explained that if CW would go to a judge and the judge grants them legal right to raise rent [mid-lease] I will be bound by that decision - one of the reasons is financial hardship."

The very fact that the woman at the leasing office stated "financial hardship" as a reason to raise rents mid-lease suggests that the idea is out there.  How seriously has this idea been considered?  That I don't know, and perhaps, hopefully, the woman was just speaking off the top of her head and not revealing a landlord's potential or even speculative plan.  If she was speaking off the top of her head, her boss should admonish her for even suggesting such a concept and potentially traumatizing all the tenants here.

I think if any landlord of this place tried to raise rents due to "financial hardship," there'd be such an uproar and revolt that New York City would have an earthquake or two.  No landlord should even think of stepping in this direction.

You just almost gave me a heart attack, STR! I'll send you my doctors' bills if you put me into cardiac arrest with a headline like that!

If they ever did that, I would simply not pay the increased rent and they would have to put me through the courts and evict me. I don't really care about my credit rating at my time of life and they would NEVER recover their money from me. Can't get blood out of a turnip!

That financial hardship clause is in the DHCR rider that is with every new lease. The landlord has to be in dire straits and not be able to keep the lights on. Digging up flowerbeds and replanting over and over and over again is evidence of having too much money on hand and not knowing or caring how to spend it wisely. They would never get away with that "hardship" shit and they would dig their own graves because we are so fed up of their bullshit that they would really have a rent strike and/or have to do mass evictions.

Mass evictions, particularly of the old time tenants, would probably be very welcome by the landlord. A major problem solved. All apartments "renovated," rents now at market rate, etc.

Look, I don't think there is any way that CWCapital could do this, but would we put it past them to try IF they could?

It's not a financial hardship when it's self inflicted. The courts will tell them to declare bankruptcy and suck it up. Life (and business) doesn't work like this. You can't get into hock over your head and then declare financial hardship. (although judging by the Bank Bailout, maybe you can ?)

The only financial hardship they could possibly allege would be due to investing in this complex at way too high a price and thus the cost of the money borrowed was major. I cannot fathom that any judge would grant a rent increase caused by the stupidity of the owners in overpaying for the property.

There's there is a lady on the TA Facebook who is having nothing short of a complete breakdown over all this. She is distraught. As horrible as it may be, it is not the total end of the world. I keep thinking about that poor little girl in Brooklyn who had her spine severed by a gang banger's bullet. At 11 years of age she is paralyzed from the neck down. Now, THAT is catastrophic. It doesn't make our situation any better, but it lends a little perspective.

Has anyone seen the list of fees they want to charge people who move out and don't leave the apartment in EXACTLY the same condition it was in when they moved in? It's ludicrous! I would rather eat shit than pay any of these charges. They can take me to court and sue me up the wazoo! Broom clean is how my apartment will be left. The cleaning and paint is their responsibility. Sheesh! they'll expect us to go wipe Sean Sullivan's butt clean next!

If an idiot wants to pay more for an item than its worth, you let them. Now to complain a financial hardship to recoup losses! Where does it end, I over tipped at the strip joint, I need to recoup my losses. The horse I bet on should have won, I need to recoup my losses.
How do we reward ineptitude, mainly by not holding anyone responsible!
